Definition of Terms

Unless otherwise provided in this Policy or the context otherwise requires, the capitalized terms herein shall have the same meaning as provided in the DPA.

“Person” means any natural or juridical person.

“Personal Data” means Personal Information and Sensitive Personal Information.

The categories of Personal Data we collect are summarized below: 

Personal Information including your name, gender, civil status, date of birth, government-issued identification; 

Contact information including your address, telephone number, mailing and email addresses;

Transaction information including billing and shipping addresses, payment method (debit or credit card information), items purchased, your eligibility for certain rewards, discounts and/or refund, related services you availed of including home delivery, assembly/installation services, sewing services and so on;

Financial data such as your bank account or credit card details; 

Demographic information such as your ZIP code, housing information such as household size, type of home and living situation and other information demographic information tied to personal information that identifies you; 

Account information including your account credentials, log-in ID, password and other information about your profile or account;

Voice recordings in relation to calls you make to our customer service team;

You may, in certain circumstances, provide us with Personal Data relating to third parties (for example, your next-of-kin or any person who may receive delivery of your purchased item on your behalf or, any person whom you have nominated as your referee if you are a candidate for employment). As the purposes for which we may/will collect, use, disclose or process your Personal Data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose(s) at the time of obtaining your consent, unless we are permitted by the DPA or any other applicable law to process your Personal Data without your consent.

When We Share Personal Data

We may share your Personal Data with third parties including our affiliates and other members of our worldwide organization, service providers, business partners, individuals and third parties.

The third parties to whom we may share your Personal Data may be situated inside or outside of the Philippines. 

The Personal Data we collect may be stored, transferred or otherwise processed in any or all of the countries which host the cloud services we utilize. 

The third parties with whom we conduct business are only authorized to use your Personal Data to perform the service for which they were hired. As part of our agreement with them, they are required to adhere to the DPA and any policies that we provide, and to take reasonable measures to ensure your Personal Data is secure. 

We respect the confidentiality of the Personal Data that you provide to us. We do not sell Personal Data to any third party.

Security Measures for Protection and Destruction of Personal Data

We have implemented appropriate technical, organizational and physical measures designed to prevent unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your Personal Data. 

However, we cannot assume responsibility for any unauthorized use of your Personal Data by third parties which are wholly attributable to factors beyond our control.

We have physical and digital systems in place to secure your Personal Data. 

We limit physical access to our data centers and facilities and allow users access to our systems only to those authorized or entitled to do so. 

We use technology controls such as firewalls, user verification, high-level encryption technology and other security tools. Unfortunately, no system or online transmission of data can be guaranteed to be 100% secure and we cannot guarantee the security of information provided over the Internet and will not be responsible for breaches of security beyond our reasonable control. It is our policy to ensure that Personal Data is only retained for a limited period as may be required by applicable law or until the purpose of the Processing is achieved. To this end, we have put in place measures to ensure that any of your Personal Data that is in our possession or under our control is destroyed and/or anonymized as soon as it is reasonable to assume that: 

(a) the purpose for which that Personal Data was collected is no longer being served by the retention of such Personal Data; and
(b) retention is no longer necessary for any other legal or business purposes.

Thereafter, your Personal Data is disposed of in a secure manner that would prevent further processing and unauthorized access by, or disclosure, to any other party.

CCTV Policy

We endeavor to protect the security of our Store/s, facilities, networks and systems and the safety of our customers, visitors, personnel and other individuals. 

To this end, we use and operate a CCTV system that captures video and photographic information of our  customers, visitors, personnel and other individuals in our Store/s to provide a safe and secure environment for everyone, protect our property, monitor security-related incidents, detect or deter fraud or crime and otherwise handle emergencies or other crises.

The access or disclosure of CCTV footage shall be subject to applicable laws, this Policy, and our applicable CCTV Policy setting forth, among others, our request protocols and approval procedures.  

Data Subject Rights

Under the DPA, you have the following rights as a data subject:

• Right to object. As a data subject, you have the right to indicate your refusal to the collection and Processing of your Personal Data, including processing for direct marketing, automated processing, or profiling. You also have the right to withhold your consent to further processing in case there are any changes or amendment to information given to you. Once you have notified us of the withholding of your consent, further processing of your personal data will no longer be permitted, unless:
  • the Processing is required pursuant to a subpoena, lawful order, or as required by law; or
  • there are other lawful bases or criteria under the DPA for the collection and Processing of your Personal Data.
• Right to access. This right entitles you to request access to Personal Data we process about you, as well as certain information on such Processing.
• Right to rectification. This right entitles you to request rectification or completion of any Personal Data that would be inaccurate or incomplete. Upon your request, and after correction has been made, we will inform any recipient of your Personal Data of its inaccuracy and the subsequent rectification that was made.
• Right to erasure or blocking. In the absence of any other legal ground or overriding legitimate interest for the lawful Processing of your Personal Data, or when there is substantial proof that your Personal Data is incomplete, outdated, false, or has been unlawfully obtained, you may request us to suspend, withdraw, or order the blocking, removal, or destruction of your personal data from our filing system.
• Right to damages. You have the right to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your Personal Data, taking into account any violation of your rights and freedoms as a Data Subject, as provided by law.
• Right to lodge a complaint. This right entitles you to lodge a complaint with the National Privacy Commission.
• Right to data portability. This right entitles you to receive a copy of Personal Data that you have provided us, in such electronic or structured format for your further use, subject to the guidelines of the National Privacy Commission with regard to the exercise of such right.Upon your passing, or in case of your incapacity or incapability to exercise your legal rights, your lawful heirs and assigns may invoke your data subject rights in your place.

Your rights as a Data Subject under this clause are subject to limitations provided by law.

Access/Correction Requests, Withdrawal of Consent and Complaints

For a request to access Personal Data we will provide you with the relevant Personal Data within thirty (30) working days from such a request being made, except as otherwise provided in this Policy. 

For CCTV-related access requests, we will, subject to the provisions of, and limitations under, applicable privacy laws, regulations and issuances,  act on your request for a copy within fifteen (15) working days after receipt of the request and/or the necessary supporting or additional documentation to confirm identity and/or authority of the requesting party, and other details related to the requested footage. Where the request is merely for viewing, we will act on your request within five (5) working days after receipt of the request and/or the necessary supporting or additional documentation. Where a request cannot be complied with within the above time frame, we will inform you of the reasonably soonest time in which we will respond. For a request to correct Personal Data, we will:

(a) correct your Personal Data as soon as practicable after the request has been made unless we have reasonable grounds not to do so;  and
(b) subject to the immediately succeeding paragraph, we will send the corrected Personal Data to every other organization to which the Personal Data was disclosed by us within a year before the date the correction was made unless that other organization does not need the corrected Personal Data for any legal or business purpose.

We may, if you so consent, send the corrected Personal Data only to specific organizations to which the Personal Data was disclosed by us within a year before the date the correction was made.

Depending on the scope and nature of the work required to process your access request, we may be required to impose a fee to recover our administrative costs. This will be assessed on a case-by-case basis by our Data Protection Officer. Where such a fee is to be imposed, we will provide you with a written estimate of the fee for your consideration and will only process your request once you have agreed to the payment of the fee. In certain cases, we may also require a deposit from you before we process the access request. You will be notified if a deposit is required when we provide you with the written estimate of the fee, if any.

You understand that we are reliant on you to provide us with accurate and complete Personal Data and with updates if there are any changes to your Personal Data. We will not be responsible for relying upon or using any inaccurate or incomplete Personal Data where you have provided with such Personal Data and/or have failed to update us of any changes in your Personal Data.

In case of withdrawal of consent, we will process your request within a reasonable time from such request being made, and will thereafter not collect, use and/or disclose your Personal Data in the manner stated in your request. Your withdrawal of consent may result in certain consequences. For example, it may mean that we will not be able to provide you with certain products or services that you have requested or that we will not be able to continue with your existing relationship with us. Pampanga Furniture Hub has installed and operates a Closed Circuit Television (CCTV) system at its premises located at 2nd Floor  Mendi Complex Bldg Mining Rd Brgy Mining Angeles City Pampanga , Philippines

This CCTV Policy describe the CCTV system and explains the safeguards we have put in place to protect personal data of any individuals who may be captured by the CCTV system cameras.

The collection, use, disclosure, storage and other processing of personal data by the CCTV system is for purposes of protecting of the security of our Store/s, facilities, networks, systems and providing and managing a safe environment for our customers, visitors, personnel and other individuals, including without limitation:

• deterring crime and anti-social behavior 
• assisting in the detection, investigation, and prosecution of offenses 
• for dispute-resolution purposes where there is a dispute as to facts and the recordings may be capable of resolving that dispute
• for the taking and defense of litigation. 

The CCTV system is not used for purposes other than those described above. 

CCTV System Description 

The cameras operate full time (24 hours a day, 7 days a week). 

There are three (3) types of CCTV cameras: fixed, PTZ and fish-eye. Fixed cameras do not allow operators to zoom in on or otherwise follow individuals. 

The cameras record movement detected in the area under surveillance as well as the time, date and location of the footage.  

The cameras do not conduct sound recording. 

Location of Cameras 

The placement or siting of CCTV cameras shall not unreasonably intrude on the privacy of individuals. 

The CCTV system provides coverage over the following areas: 

• entrances to the store
• exits from the store, including emergency exits
• customer service areas
• waiting areas
• corridors and hallways
• warehouse
• cash lines  
• other areas as required by the business.

Our CCTV systems do not infringe on restricted areas (i.e. toilets/restrooms, lactation or breastfeeding rooms, and other similar places).  

Upon installation, all equipment is tested to ensure that only the designated areas are monitored.

Notices 

The public shall be notified of CCTV surveillance operations through signage installed near the areas monitored. 

Public-facing CCTV Notices that briefly describe, among others, the CCTV system processing, the location of cameras, the retention period, process for requesting CCTV footage, will also be prominently placed in various spots in the premises. 

Authorized Personnel

Footage captured and recorded by the Company is accessible only to our Safety and Security Team and other personnel who may be specifically authorized and the Data Protection Officer. Service Providers engaged by Pampanga Furniture Hub to ensure safety and security of the premises and/or the operation and maintenance of the CCTV System may have access to footage only where strictly required to perform their tasks, and are prohibited from using the footage for any other purposes. 

Video Quality 

The images and/or footage produced by the equipment will as far as possible be of a quality that is effective for the purpose(s) for which they are intended. 

Security Measures

The CCTV System is used as a complement to other security measures implemented to safeguard the security of our Store/s, facilities, networks and systems and the safety of our customers, visitors, personnel and other individuals. The CCTV System enhances other access control and physical intrusion prevention systems within our premises. 

Access to the images recorded by our CCTV System is restricted and carefully controlled. 

The security of the IT systems containing the CCTV footage is safeguarded through technical, organizational, and physical means. 

Footage recorded by our CCTV cameras are encrypted and otherwise stored in a secure manner to protect their confidentiality, integrity and availability. The digital perimeter of the IT infrastructure is protected under our Privacy Policy and IT Security Policy. 

The CCTV monitoring and storing equipment is kept in a segregated, secure area to which only authorized personnel with security clearance are granted access. 

All persons with access to the CCTV System are under binding/contractual confidentiality commitments. 

Security protocols have been put in place to ensure that only authorized personnel are allowed to view, monitor and otherwise process CCTV footage. 

Upon installation, all equipment is tested to ensure that suitable quality pictures are available in live and play back mode. All CCTV equipment is maintained regularly.

Procedure for Access Requests 

Individuals who request access to CCTV footage must submit this formally in writing, with sufficient details to identify the section of footage with which they are concerned and to enable the Company to determine that the person making the request is the data subject of that specific recording.

Upon receipt of the written request, it is referred to the Safety and Security Team and the Data Protection Officer who will determine whether disclosure is appropriate. 

Our response in allowing access to CCTV footage and will consider ease of access to the footage and the need to protect other people’s privacy.  

Disclosure/Transfer

Access granted to CCTV footage is tiered: either by viewing or providing a copy, the latter option being allowed only when proportional to the purpose of the request. At all times, the footage to be disclosed, either by viewing or providing a copy, are only those that are necessary and not excessive to the purpose for which they are being disclosed.

CCTV footage may be disclosed in the following instances:

• Law enforcement and criminal investigations. On requests for CCTV footage to be disclosed in relation to a criminal investigation, the Company shall require the law enforcement officer or the requesting party to provide sufficient proof as to the occurrence of a crime and the investigation thereof as well as proof of authority of the law enforcement officer before release of the CCTV footage.
• Court Order. Requests for disclosure and use of CCTV footage and images by virtue of a lawful order of a court of competent authority is allowed, taking into consideration the pertinent rules on issuance of subpoena. 
• Administrative investigations. Use of CCTV footage for purposes of an administrative investigation may be allowed. The requesting party must provide sufficient proof of the investigation being conducted or the pending complaint before an administrative body.
• Other third-party requests. Third-party access requests for CCTV footage and images is evaluated on a case-to-case basis with due regard to the rights to privacy of individuals. 

We shall act on viewing requests within five (5) working days from receipt of the request or of required additional supporting documents; while requests for copies of CCTV footage will be acted upon within fifteen (15) working days after receipt of the request or of required documentation. We may charge a reasonable fee for providing a copy of the CCTV footage to cover administrative costs. 

Retention Period 

CCTV recordings are generally maintained for ninety (90) calendar days and are thereafter overwritten making recovery impossible, except that they may be kept for a longer duration in certain instances including: 

• where there is legal basis 
• where we are legally required to do so, or 
• where the footage otherwise has investigative value (such as where a security incident occurs) and the recordings are stored as necessary for the duration of the investigation, the prosecution of the incident or the exercise, enforcement or defense of any legal claims.

The foregoing list is not exhaustive and there may be other circumstances where the CCTV is retained for longer than ninety (90) calendar days as is justified under the circumstances.

Where an incident or suspected incident has been identified under the appropriate procedures mentioned in this Policy, the pertinent portion of the CCTV footage is to be retained for that incident.

Regular Review 

Pampanga Furniture Hub undertakes yearly periodic reviews of the CCTV System and the associated internal policies, procedures, protocols and processes. These reviews will be used to assess the continued need for the CCTV System, as well as the adequacy, necessity and proportionality of the CCTV System.
